If you do not know yet, effective October 1, 2005, you are required by Public Act 493 and 495 of 2004 to do one of the following when selling or transferring a vehicle:

1. Accompany the purchaser to a Secretary of State office to assure the vehicle title is transferred, or
2. Maintain a record of the sale for at least 18 months

A "record of the sale" means either a photocopy of the reassigned title or a document that includes the name, address, driver's license number, purchase price, date of the sale or transfer, vehicle identification number and signature of the new owner or purchaser. A person who does not maintain a record of the sale is responsible for a civil infraction and subject to a $15 fine plus costs, state assessments and other statutory penalties.

Abandoning a vehicle is prohibited under the Michigan Vehicle Code and a person who fails to redeem an abandoned vehicle before disposition is responsible for a civil infraction with a civil fine of $50 plus costs, state assessments and other statutory penalties.

Abandoning a vehicle is alsoa violation of the Natural Resources And Environmental Protection Act. A person abandoning a vehicle is responsible for a state civil infraction and is subject to a civil fine of not less than $500 or more than $2,500 for the first occurence and not less thn $1,000 or more than $5,000 for subsequent occurences.

The last titled owner is presumed to be responsible for abandoning the vehicle unless the person provides a record of the sale as defined above
